Terms of Service

1. General

These terms and conditions are applicable to the supply of Product(s) made by the Seller, hereafter referred as www.allarabic.in, to the buyer hereafter referred to as the Customer.

2. Price

– All prices are quoted in Indian Rupees (INR) and are inclusive of GST (If applicable) (as may be prescribed by law from time to time), unless otherwise specified.

– All prices are inclusive of postage and packing unless otherwise stated.

3. Payment

Payments must be made in Indian Rupees.

All types of credit/debit cards are accepted.

We do not offer Cash on Delivery (COD).

4. Passing of property

www.allarabic.in shall retain the property of the goods until full payment has been made by the customer and has been received.

5. Passing of risk

The risk in the goods shall pass to the Customer on delivery.

6. Refund(s) and Return(s)

We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the pre-set limit mutually agreed by us with our acquiring bank from time to time.

Our packaging and logistics department ensures that the product(s) are carefully packaged. We assure our customers that our Product(s) cannot be damaged during transportation. We therefore will not make any refunds for claims which state that the Product(s) were broken in transportation.

7. Your Rights to Cancel this Contract

If this contract has been made between us by telephone or correspondence (including e-mail) without any face-to-face contact having occurred between us, then you will have 24 hours from the date when the order is placed in which to cancel this contract. This right does not apply at any time after the product(s) is dispatched.

8. Responsibility for and Ownership of Goods

You will be liable for any loss or damage to the goods from the time of delivery unless such loss or damage is caused by our negligence.

9. Re-sale of Goods

Goods are sold on the condition that they are not re-sold to the public.

10. Our Responsibilities

We will meet our responsibilities under this contract within a reasonable time unless it is impossible for us to do this because of circumstances outside of our reasonable control. In particular, we will not be responsible for delays caused by our suppliers.

11. Contract Personal to You (Your limited right to transfer the contract)

This contract is personal to you. Nobody other than you will be able to benefit from this contract. You may not transfer your rights or the benefit of any of the provisions of this contract to any other person without our prior written permission.

12. Our Right to Transfer the Contract

We may assign or sub-contract the contract or any part of the contract to any person, firm or company.

13. Your Personal Data

We will ensure that our employees, agents and sub-contractors shall, at all times, comply with the provisions of the Data Protection Act 1998 concerning data received from you with this contract and shall only process personal data received from you whenever necessary to fulfil our obligations under this contract.

14. Use of Cookies

(A.) A cookie is a text-only string of information that a website transfers to the cookie file of the browser on your computer’s hard disk so that the website can remember who you are. A cookie will typically contain the name of the domain from which the cookie has come, the “lifetime” of the cookie, and a value, usually a randomly generated unique number.

(B.) When you visit our website, we send you a cookie. Cookies may be used in the following ways:

(B.1) To help us recognise you as a unique visitor (just a number) when you return to our website and to allow us to tailor content or advertisements to match your preferred interests or to avoid showing you the same adverts repeatedly.

(B.2) To compile anonymous, aggregated statistics that allow us to understand how users use our site and to help us improve the structure of our website. We cannot identify you personally in this way.

(C.) 15. Communications

Any communications between us regarding this contract that are required to be in writing must be sent by first class post, facsimile or delivered by hand. Any written communication will be treated as having been served on the person receiving it 3 working days after posting (if sent by first class post), at the time of transmission (if sent by facsimile and a satisfactory transmission report is obtained) and at the time of delivery (if delivered by hand).
